Terms of Service
These Terms of Service ("Terms") govern your access to and use of the services provided by In Motion Transport LLC. Please read these Terms carefully before using our services.
1. Agreement to Terms
By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the services. If you are accessing and using the services on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2. Transport and Logistics Services
In Motion Transport LLC provides a range of transport and logistics services, including but not limited to freight transportation, shipment coordination, and delivery support. The specific details, scope, timelines, and deliverables of the services will be outlined in a separate Statement of Work (SOW) or service agreement between In Motion Transport LLC and the client.
3. Payment Terms
Fees for our services will be detailed in the client's SOW or service agreement. Unless otherwise specified, payments are due upon receipt of the invoice. Late payments may incur interest charges. Services may be suspended or terminated for non-payment.
4. Client Responsibilities
The client agrees to provide In Motion Transport LLC with all necessary information, data, and access details required to perform the agreed-upon services. Delays in providing this information may impact project timelines and results.
5. Confidentiality
Both parties agree to keep confidential all non-public information received from the other party. This includes business strategies, client lists, and performance data. This obligation of confidentiality will survive the termination of any service agreement.
6. Limitation of Liability
While In Motion Transport LLC strives to provide the highest quality services, we do not guarantee specific outcomes or results. Shipping and logistics conditions can change, and factors beyond our control can affect delivery performance. To the maximum extent permitted by law, In Motion Transport LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
7. Termination
Either party may terminate the service agreement with written notice as specified in the SOW. Upon termination, the client is responsible for payment for all services rendered up to the date of termination.
8. Changes to Terms
We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on the In Motion Transport LLC site. You are advised to review these Terms periodically for any changes.
